These legal notices govern the use of the cloud storage service for storing and listening to mp3 music files, provided by the sole proprietorship Fabrice Frattini, whose headquarters is located at 10 rue du castel, 94000 Créteil, registered with the Créteil RCS under the number SIRET 94926213300018.

Service Description

The Service allows users to access a cloud space to upload and store their personal music in MP3 format. These files can be accessed via any modern web browser or through a dedicated Android application called Stream My Music.

Acceptance of Terms

By using the Service, the user unreservedly accepts these legal notices. If the user does not accept these terms, they are advised not to use the Service.

Terms of Use

• Legality of Files: The user agrees to only upload mp3 files to the Service for which they possess intellectual property rights or have obtained a legal license. All uploaded mp3 files must have been legally acquired. The sole proprietorship Fabrice Frattini cannot be held responsible for any copyright violations or other legal infringements committed by the user.
• Personal Use: The Service is strictly for personal and private use. Any commercial use or illegal sharing is prohibited.
• User Conduct: The user agrees not to abuse the Service, including attempting to unauthorized access to the Service or associated computer systems.

Hosting and Liability

• Hosting Provider: The cloud storage is hosted by a third-party provider, O2Switch, located at Chem. des Pardiaux, 63000 Clermont-Ferrand. While the sole proprietorship Fabrice Frattini strives for reliable and secure hosting, it cannot be held responsible for service interruptions, data loss, or any other technical failures of the host.
• Data Loss: The sole proprietorship Fabrice Frattini disclaims any liability in case of data loss. Users are encouraged to maintain backup copies of their music files. In no event shall the sole proprietorship Fabrice Frattini be liable for direct or indirect damages, loss of profit, or loss of opportunity related to the use or inability to use the Service.

Pricing and Payments

The Service offers a free plan with 50 MB of storage. The paid plans are as follows:

• 250 MB for 1,50 euros per month for French users and 1,50 dollars per month for users from other countries,
• 500 MB for 3 euros per month for French users and 3 per month dollars for users from other countries,
• 1,000 MB for 5 euros per month for French users and 5 dollars per month for users from other countries.

Payments and Recourse

• Payment: The user subscribes to a plan with automatic payments managed by the PayPal payment platform. If a payment deadline is not met, the Stream My Music service may be suspended.
• Withdrawal: The user has a 14-day withdrawal period after the purchase date to request a refund.
• No Recourse: By subscribing to the Service, the user agrees not to seek recourse against the sole proprietorship Fabrice Frattini in case of data loss, service interruption, or any other damage. No requests for refunds or compensation will be accepted, except within the aforementioned withdrawal period.

User Commitment

The user agrees not to illegally share files stored on the Service and to comply with the applicable intellectual property and copyright laws. Any infringement may result in the immediate and without notice termination of access to the Service, without any possible refund.

Modification of Legal Notices

The sole proprietorship Fabrice Frattini reserves the right to modify these legal notices at any time. Users will be informed of these changes by appropriate means.

Governing Law and Jurisdiction

These legal notices are governed by French law. Any dispute related to the execution or interpretation of these notices will be subject to the exclusive jurisdiction of the courts of Créteil.
